- Warning in the ad
None for most ads. Concentrate ads need MED's overconsumption-risk notice
- License number in the ad
Not required by the advertising rules

What this means for a streaming TV spot
- Rule 3-720 covers both television and internet advertising, so a streaming TV spot is held to the 71.6% rule.
- Keep the audience composition data behind every buy. Colorado requires it in your advertising records.
- Most spots need no warning. A concentrate spot needs MED's overconsumption-risk notice, and we put it on screen.
- No cartoon characters, nothing aimed at under-21s, and no claim that a product is safe because it's regulated or tested.
Required warnings
Concentrate ads: overconsumption-risk notice
Delivery not specified in the rule
MED Industry Bulletin 22-06 lists four statements: psychotic symptoms and/or psychotic disorder (delusions, hallucinations, or difficulty distinguishing reality); mental health symptoms/problems; cannabis hyperemesis syndrome (CHS) (uncontrolled and repetitive vomiting); and cannabis use disorder/dependence, including physical and psychological dependence.
MED hasn't said whether the notice must be on screen or spoken. Bulletin 25-10 (August 29, 2025) also covers concentrate advertising; check it for current wording.
License disclosure
Colorado's advertising rules don't require a license number or licensee name in the ad.
What you can't run
Deceptive, false or misleading advertising.
Ads designed to appeal to minors, and content that specifically targets people under 21, including cartoon characters.
Branding, including taglines, that targets people under 21.
Claims that a product is safe because the state regulates it or because it was tested.
Health or physical-benefit claims (the statute directs MED to prohibit them).
Unsolicited internet pop-up ads.
Targeting rules
Marketing to location-based devices such as phones is allowed only through an app the owner installed, the owner is 21 or older, and the app has a permanent, easy opt-out.
Opt-in marketing must include an easy, permanent opt-out.
Medical
The 71.6% rule applies to medical and retail alike. Medical businesses are expressly barred from directing ads at people under 21, and 'minor' means under 18 for medical and under 21 for retail.
Hemp-derived THC
Under SB23-271, intoxicating hemp products are generally limited to MED licensees, hemp products with more than 1.25 mg THC can't be sold to people under 21, and hemp products may not be marketed as containing THC or other intoxicating cannabinoids.
Recent and upcoming changes
MED's current rules took effect January 5, 2026. The 2026 annual rules were adopted September 10, 2026 and take effect November 1, 2026.

Questions
Can a Colorado dispensary advertise on streaming TV?
Yes, when at least 71.6% of the audience is reasonably expected to be 21 or older and the ad avoids the content Colorado bans, such as anything aimed at under-21s or deceptive claims.
Does a Colorado cannabis TV ad need a warning?
Most don't. Ads for marijuana concentrates must carry MED's overconsumption-risk notice.
What records do I need to keep?
Advertising and marketing records, including audience composition data, for the current and prior calendar year under Rule 3-905.
Can my ad reach viewers outside Colorado?
Colorado's current advertising rules don't contain an express out-of-state targeting rule. We keep every cannabis campaign inside the state that licensed it.
